Course Content

Day 1 / Module 1: Foundations of Indian Intellectual Property Law
This theme introduces participants to the meaning, nature and purpose of Intellectual Property Rights and explains the distinction between tangible and intangible property. It provides an overview of the major forms of intellectual property protection available in India, including patents, trademarks, copyright, industrial designs, geographical indications, trade secrets and confidential information, as well as emerging rights such as personality rights. The theme also examines the constitutional, economic and commercial foundations of intellectual property protection and highlights the role of IP rights in promoting innovation, creativity, investment, brand development and commercial growth. Participants will gain an understanding of India’s intellectual property framework and the functions of key institutions, including IP India, the Copyright Office, courts and relevant adjudicatory bodies. The theme further covers the international foundations of intellectual property law through an introduction to the TRIPS Agreement, the World Intellectual Property Organization, the Paris Convention, the Berne Convention and the Madrid Protocol. It also discusses the National Intellectual Property Rights Policy and its significance within India’s broader innovation and entrepreneurial ecosystem. By the end of this theme, participants will have developed a clear and confident foundation in Intellectual Property Law and will understand how different intellectual property rights protect innovation, brands, creative expression and commercial value.

Day 2 / Module 2: Trademark Law, Brand Protection and Passing Off
This theme introduces participants to the meaning and commercial function of trademarks as tools for identifying the source of goods and services and protecting brand identity, goodwill and market reputation. It covers the different types of trademarks recognised under law, including word marks, device marks, logos, shape marks, colour marks, sound marks, collective marks, certification marks and well-known marks. Participants will examine the absolute and relative grounds for refusal of trademark applications and gain a practical understanding of trademark searches, classification of goods and services and the basic requirements for filing an application. The theme explains the trademark registration process under the Trade Marks Act, 1999 and the Trade Marks Rules, 2017, along with opposition, rectification and cancellation proceedings. It also explores the legal principles governing trademark infringement and passing off, with particular emphasis on deceptive similarity and the likelihood of confusion among consumers. Contemporary issues involving domain names, social-media handles, influencer brands and the unauthorised use of brands in digital spaces will also be addressed. Participants will further study the remedies available in trademark disputes, including injunctions, damages, accounts of profits and delivery up of infringing materials. By the end of this theme, participants will understand how brands are legally protected, how trademark disputes arise and how lawyers advise clients on registration, infringement, passing off and online brand misuse.

Day 3 / Module 3: Copyright, Designs and Creative Industry Protection
Part A – Copyright Law: This part covers the scope of copyright protection, originality, authorship, ownership, licensing, moral and performers’ rights, fair dealing, digital piracy, social-media content, platform liability, copyright societies, royalties and remedies for infringement. Part B – Designs Law: This part explains industrial design protection, the difference between copyright, trademarks and designs, registrability, novelty, design piracy and remedies under the Designs Act, 2000 and Designs Rules, 2001, with practical relevance to fashion, packaging, jewellery, automobiles and consumer products.

Day 4 / Module 4: Patent Law, GI, IP Enforcement, Licensing and Career Pathways
Part A – Patent Law: This part covers patentability, novelty, inventive step, industrial application, excluded inventions, filing and specification requirements, publication, examination, opposition, infringement, compulsory licensing and emerging issues involving pharmaceutical patents, software and AI-generated inventions. Part B – Geographical Indications and Other IP Rights: This part explains GI protection, registration, authorised users, enforcement and its importance to India’s rural economy. It also introduces plant variety protection, farmers’ rights, trade secrets and confidential information. Part C – IP Enforcement, Licensing and Careers: This part covers civil and criminal remedies, licensing, franchising, assignment agreements and IP issues in employment, start-ups and collaborations. It also introduces career opportunities in IP litigation, prosecution, portfolio management, corporate practice, technology, media, policy, research and academia.
